Nice to meet you and welcome to our network “Con.tact”. When reference is made to “we” or “us” in these Terms of Use, this means

V2. What we do

V2.1 We operate a just-in-time online network “con.tact” for love, life and career. Our motivation is to move online dating from virtual to real life. To do this, you create a unique profile of yourself, your hobbies and your interests. 

V2.2 For many people it is difficult to take the first step. We take this challenge off your hands with our “matching algorithm”. This means that random, spontaneous encounters do not go unnoticed. The algorithm learns diligently and can decide which person suits your hobbies and interests. So “matches” are not randomly suggested to you, but only potential companions.

V2.3 If you and your “match” run into each other, be it while shopping, at a festival or in a bar, you will receive a notification and can contact your “match” via the integrated messenger directly or at a later date Get in touch. 

V2. Reading aids for the terms of use

We use definitions to make our Terms of Use clearer. The following definitions therefore apply: 

  • “Network” includes the entire offer that we make available to you. This includes the app and its functions, the programming language behind it and all associated technical aids;
  • “Members” are the people who have registered on our network; 
  • “Use” means any action by which a Member discloses, transmits, stores, publishes, distributes or otherwise makes available information and data to us;
  • “Account” means the area of a Member in which the Member can use images and information to create a personal profile;
  • “Partners” are companies with which we work together. 
  1. Registration

1.1 General

To participate in our network, a one-time, free registration is required. By registering you agree to this

  • These Terms of Use;
  • Our Privacy Policy (hyperlink) and our Community Guidelines (Hyperlink).

By registering, you also confirm that your information is true, current and complete. You also confirm that you do not yet have a user account on our network.

1.2 Registration Types

We offer you three different options to register in our network:

1.2.1 You can register with your phone number. To do this, you must provide your personal data completely and correctly in our registration form, unless it is marked as voluntary information. When you create your account, you will receive a verification code on your mobile phone.

1.2.2 You can register by taking over the registration data from the social network Facebook. This requires confirmation that the data provided and verified there can be transmitted. You will receive a confirmation via email to the email address linked to your Facebook account.

1.2.3 You can register with your Apple ID. This requires confirmation that the data provided and verified there can be transmitted. You will receive a confirmation email to the email address associated with your Apple ID.

1.3 Registration

After your successful registration you can log in to our network.

You must be at least 18 (eighteen) years old to register and log in to our network. If an older age is required by applicable law, this will be considered the minimum age.

    1. Responsibility and reporting obligations

You are responsible for the confidential treatment of your data. You must therefore report to us any suspicion of misuse of your account by a third person. Misuse occurs in particular if: 

  • an unauthorized person is using your account;
  • an unauthorized person gains access to your data or
  • you or an unauthorized person is using your account fraudulently.
  1. Your rights and obligations 
    1. We grant you a worldwide, royalty-free, non-transferable, non-sublicensable, revocable and limited right to use our network. Your right of use exists exclusively for the purpose of the contract. There is no implied grant of license or grant of rights beyond these terms of use.
    2. You agree to only use content that you have the right to share.

3.3 You agree not to do the following:

  • Using our network for commercial purposes unless you have our written permission;
  • Taking harmful actions that could jeopardize the security of our network or otherwise affect the network (e.g. computer viruses, malicious code, etc.);
  • Use of automated devices, methods or processes to access, retrieve or reproduce network content (e.g. data mining, crawlers, bots, etc.);
  • Modify, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble our network, or incite or assist in any such act;
  • Use of racist, violent, sexually offensive or other offensive or discriminatory content;
  • Sending chain letters.

3.4 You undertake to update your information regularly. You may not transfer the rights and obligations that we grant to you under these Terms of Use to any third party without our consent.

  1. Rights and obligations of us
    1. Granting of usage rights

4.1.1 You grant us a worldwide, royalty-free, transferable, sublicensable and perpetual right to use all content you use on our network for the purpose of providing services on or in connection with our network and only to the extent necessary. This also includes the right to change, edit and reproduce, provided this does not affect your legitimate interests. You remain the owner of the legally binding and indispensable rights to which you are entitled.

4.1.2 You grant us the right to receive information about the information in Section 4.1.1. to process the purposes mentioned for which you grant us access. This includes in particular the right to

  • host;
  • save;
  • to use;
  • copy;
  • to represent;
  • reproduce;
  • adapt;
  • edit;
  • publish;
  • change;
  • spread.

The right to process also includes the content that you transmit to other members. You agree that content you use on our network may be viewed by other members. You have the option to specify in your account whether content should be hidden for certain members.

4.1.3 Within the scope of your right of determination in accordance with Section 13 Sentence 2 of the Copyright Act, you waive the right to be named and designated as the author within the scope of the exploitation of the contractual rights, unless important rights require you to be named.

4.1.4 We receive an exclusive right of use for modified works created by con.tact.

4.1.5 We reserve the right to monitor, review and delete your content if it violates our Terms of Use. In this case we will inform you about the deletion. 

    1. Advertising

4.2.1 You agree that we, our affiliated companies and partners may place advertising on our network. 

4.2.2 Content in advertisements or promotions that are not offered by us on the network do not come from us, but from the respective provider. 

    1. Contact

We reserve the right to contact you at any time to verify the information you have used. 

  1. Community Guidelines and Privacy Policy

You confirm that you are not against ours Community Guidelines and violates our privacy policy.

  1. Security

6.1 We are not responsible for the behavior of members within or outside our network. You must therefore ensure that you exercise caution and take appropriate safety precautions in all interactions, whether online or in person. This includes, in particular, not disclosing any financial or other personal data that an unauthorized person could misuse. 

6.2 We do not check your background and past, nor do we check the backgrounds of other members. 

  1. Changes and Termination Rights 
    1. Changes

7.1.1 We reserve the right to change the options, the features and these Terms of Use. We are making the changes in particular in order to 

  • to incorporate changes in the law;
  • to accommodate your interests and the interests of the other members;
  • optimize our network;
  • to correspond to economic efficiency.

7.1.2 If there are any changes that affect your rights and obligations, we will provide you with reasonable notice at least 30 (thirty) days in advance. We would like to point out that you can object to the change within four weeks of receiving the notification and a failure to object will result in your consent to the changed terms of use being deemed to have been granted. In the event of an objection to the proposed changes, we reserve the right to terminate your account. 

    1. Your right to cancel

You have the right to terminate your participation in our network at any time. You have the option to do this in your account. You must confirm the cancellation. We will then delete your data within a reasonable period of time, but in any case within the legal provisions.

    1. Our right of termination 

Our network is free for members. We may therefore temporarily suspend you from participating in our network or exclude you completely if there is good cause. An important reason exists in particular if you

  • violates your obligations under Section 3.3;
  • violates our community guidelines;
  • use incomplete, incorrect or outdated information;
  • you are already registered with another account in our network.

Without an important reason, we can terminate your participation at any time with [X] months’ notice.

  1. Warranty

8.1 In the event of product or legal defects, you are entitled to the statutory rights. 

8.2 We do not provide any additional guarantee that the network will be available to you uninterrupted, error-free and secure.

  1. Limitations of Liability

9.1 Claims against us for damages are excluded. Excluded from this are claims for damages resulting from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by us, our legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

9.2 In the event of a breach of essential contractual obligations, we are only liable for the foreseeable damage that is typical for the contract if this was caused simply by negligence, unless it concerns claims for damages resulting from injury to life, body or health.

9.3 To the extent that liability is excluded or limited above, this also applies with regard to the personal liability of our respective employees, employees and organs as well as our vicarious agents and vicarious agents, including their employees, employees and organs.

  1. Final provisions

10.1 Applicable law, place of jurisdiction

German law applies to all disputes arising from and in connection with these terms of use, with the exception of the UN Convention on Contracts for the International Sale of Goods. 

10.2 Miscellaneous 

You acknowledge that your account is non-transferable and that all of your rights in or to the account and in or to the content thereof terminate upon your death.

10.3 Written form

10.3.1 Changes to the terms of use must be made in writing. This also applies to the modification or cancellation of the above written form requirement. 

10.3.2 Deviations are only effective if they are made expressly and with specific mention of the changed provision.

10.4 Severability clause

Should a provision of these terms of use be or become invalid or unenforceable, the effectiveness of the remaining provisions will not be affected. In place of the invalid provision, you and we will agree on a new provision that comes as close as possible to the intended provision and is legally valid.
